Netherlands: Negative results in inspection of arcades

A few weeks ago, the Gaming Authority announced in the Netherlands that they will carry out more checks. Of course, player safety was the priority here. However, it should also be checked whether the provisions of the Gambling Act are being observed. After all, gambling has only recently been legalized in Holland. Therefore, one cannot necessarily assume that all regulations and rules are already being observed.

When checking the KSA, numerous entry controls were found. The link to the central player register is also missing.(©TBIT/Pixabay)

20 arcades have been investigated so far

When announcing the The KSA did not announce which arcades and how many should be controlled. So basically anyland based casino or arcade could expect to be controlled. As it stands at the moment, many haven't taken it seriously enough. Otherwise such a negative result would hardly have been observed. Most of the controlled casinos and gambling halls do not fully comply with the new guidelines.

Primarily, therules of admission control are ignored. In this context, the regulation of data collection was not complied with either. Casinos are required to keep a record of each player's name and how much time they spend at the casino. Furthermore, all visits must be noted. This is based on total control of gaming behavior. Exactly against this control many casinos seem to have violated. At least that was the result of the checks carried out by theKSA.

But what is the point of this strict data collection? This is intended to determine whether the customer's gaming behavior has changed. Should it change negatively, so that a gambling addiction could exist, the gambling operator must intervene. For example, he must hold advisory talks - but other measures are also possible.

Casino may block players

Should a reasonable conversation with a gambling addict not lead to success, the gambling provider may also have them blocked. TheApplication to ban a player can also be made without the player's consent. Furthermore, in the Netherlands it would also be possible for family members, acquaintances and even social workers to apply for the blocking. Before the ban is implemented, the person concerned has the opportunity to express themselves. If no agreement can be reached, the court or an expert in the Netherlands can decide.

The entry is made in CRUKS. This is acentral register in which all data is collected. Gambling providers must link to this register in order to recognize blocked players. It is positive that it is a central register for online and local players. A blocked player cannot switch to the other type of game.

There is a sophisticated system behindCRUKS: Everyone who wants to play in the Netherlands has to register either via the DigiD database or directly with the KSA make a registration. This registration is necessary so that a CRUKS code can be created for each registered player. This code is checked against the blacklist every time a player enters an on-site casino. This check did not take place at some casinos.

Reasons for violations determined

The KSA took its task very seriously and not only carried out the controls. At the same time theresults were analyzed. The KSA was able to determine that many local gambling establishments are not yet connected to the blocking system. However, the provisions of the new Gaming Act clearly state that the operators themselves must take care of this necessary connection. The inspected companies have already started with this task, but have not yet completed it.

Thus, the controlled gambling establishments do not have to expect any consequences. At least, such were not publicly announced. However, you should hurry to connect to the central lock file. Thenext checks have been scheduled for April 2022. However, this relatively long period of time passes very quickly. Apart from the local providers, however, the online casinos also have to make an effort to be able to use the lock file.

Law regulates online casinos and local gaming venues

The new law, which requires local gaming halls to observe the strict rules, only becamethis April year valid. With this new law, online gambling has been legalized for the first time in the Netherlands. Thus, this country was one of the last European countries to regulate online gambling. Until then, online gambling was illegal.

The first online gambling providers were able to start their work in October. However, a prerequisite for obtaining the license was that the online casinos immediately link to the central register. The online casino may not be offered without this link. Thus, the online gambling providers definitely have a harder time. Land-based casinos haveapparently received an unofficial transition period. This can therefore be concluded from the fact that the controlled providers cannot expect any penalties.

However, it can be assumed that in the future online casinos will also be checked to see whether there is alink to the lock file and whether the ones explained above exist Measures in the event of gambling addiction are observed. In any case, it remains exciting to see how the KSA proceeds.
